The effort by Transport Workers United Local 100 retirees to stop the imminent switch of their health plan benefits from government-run Medicare to privately administered Medicare Advantage programs has hit a roadblock, with the judge overseeing their petition lifting his injunction just days after he had issued it.
Manhattan Civil Court Supervising Judge Shahabuddeen A. Ally dropped the temporary restraining order Dec. 22 following a torrent of affidavits from New York City Transit lawyers and union representatives that followed the Dec. 18 TRO that allege, in one case, “multifaced harm” if the switch is further delayed.
