After the de Blasio administration attempted to remove unvaccinated educators who have serious medical conditions from the payroll, an arbitrator ruled Sept. 10 that it must provide them with non-classroom positions.
Educators who receive medical or religious exemptions to the vaccine mandate imposed by the city must be given an accommodation to work remotely or in a non-school-building setting, Arbitrator Martin Scheinman determined. The policy also applies to educators who have gotten the coronavirus vaccine but have not produced antibodies because they have suppressed immune systems.
