The New York State United Teachers filed a lawsuit Sept. 15 in Albany County Supreme Court contesting the state Division of Budget’s decision to withhold 20 percent of aid for school districts and demanding that the funds be released.
The lawsuit alleges that when Governor Cuomo granted Budget Director Robert Mujica authority to withhold funding for localities because of shortfalls in the state budget due to coronavirus, the move “violated the separation of powers provided for in the State Constitution’s budgetary process.”
