Lawyers for Gwen Carr, the mother of Eric Garner, the Staten Island man who died following a confrontation with police in July 2014, filed suit in State Supreme Court last week seeking the right to obtain sworn testimony from participants in the arrest of Mr. Garner, as well as those of other police and city officials.
The lawyers said they were hopeful the so-called judicial inquiry, if granted, would allow for wide-ranging questioning of the officers and city officials, among them Commissioner James P. O’Neill and Mayor de Blasio. Subsequent public pressure could compel prosecutors to take action against officers who were present during Mr. Garner’s arrest for allegedly selling untaxed cigarettes, as well as those involved in the incident’s aftermath and investigation, they said.
