Judge Upholds Law On Fast-Food Workers Getting Hours Early

A State Supreme Court Justice Feb. 18 upheld the city’s Fair Workweek Law, which was passed in 2017 and protects workers from unpredictable scheduling, after three restaurant industry groups attempted to block the measure by arguing that it was pre-empted by state wage laws.

The law requires fast-food and retail businesses to provide their employees schedules in advance, and to give priority to current employees when new shifts became available. Three employer associations sued the city, arguing that the law conflicted with state rules related to wages and hours of employment.
