The state’s highest court has ruled that all police officers are entitled to childcare-leave pension benefits, rejecting the city’s claim that cops hired after 2009 and placed into Tier 3 of the city retirement system were not eligible for the perk.
In its Oct. 20 opinion overturning an Appellate Division decision, the State Court of Appeals found that two simple words—“any member”—within a portion of the city's Administrative Code effectively guaranteed officers a right to buy back pension credit for unpaid child-care leave.
