S.I. Judge Rejects a Petition to Open Grand-Jury Records in Garner Case

A Staten Island judge last week rejected a request by civil-rights groups and Public Advocate Letitia James to open the grand-jury records in the Eric Garner case to the public, saying that informing the public why the jurors declined to indict a police officer who used significant force against him was not sufficient reason to release them.

The grand jury’s decision, announced in early December, fueled outrage. Mr. Garner was one of several unarmed black men who died at the hands of police officers around the country. Staten Island District Attorney Dan Donovan said at the time that he was constrained from explaining the panel’s reasoning because grand-jury proceedings are secret by law.
