The Board of Collective Bargaining has ruled that the Police Department violated the city’s Collective Bargaining Law when it banned Police Officers placed on modified assignment from eligibility for overtime pay without negotiating on the issue with their union, the Patrolmen’s Benevolent Association.
The 3-2 ruling, which was issued in mid-October but not publicized until last week, requires the department to discontinue a practice it imposed after an outcry was sparked by a Daily News article highlighting that cops placed on modified assignment, including Officer Daniel Pantaleo—whose chokehold during a confrontation with Eric Garner four years ago was believed to have played a role in his death—were supplementing their base pay with overtime while confined to desk duty.
