An NYPD top judge denied a motion May 9 to dismiss charges against Police Officer Daniel Pantaleo, setting the stage for the officer’s disciplinary trial to begin Monday before the Civilian Complaint Review Board, nearly five years after the death of Eric Garner following a confrontation with police on Staten Island, an incident replayed untold number of times after it was captured on video by a bystander’s cellphone.
Although Mr. Pantaleo will be tried on administrative charges, prosecutors must meet a burden of proof greater than just whether he violated the NYPD’s Patrol Guide by using a department-banned chokehold since that charge was not filed within the 18-month statute of limitations.
