An Emergency Medical Service Lieutenant, with the help of his union, has filed an appeal in state court seeking to expunge from his FDNY record a finding that he made racially disparaging remarks while off-duty.
Richard Erdey, a 16-year EMS veteran, received a note in his personnel file in December 2011 when a man complained to the Fire Department that he’d made offensive remarks to him about Latinos and people of color. The Lieutenant vehemently denied having done so, and argued that the letter—which said the Equal Employment Opportunity office had substantiated the claims—was stigmatizing and would affect his chances of promotion.
